    THIS AGREEMENT made by and between the City of Shelbyville by its Board of Parks and Recreation (hereafter referred to as “City”), and the above named Applicant and/or Group, (hereafter referred to as “Applicant”), WITNESSETH:

    A.    City, in consideration of the rents and covenants herein contained, does hereby agree to allow Applicant the use of the above-named pavilion at the above-named dates and times. Neither applicant nor any guests may occupy other spaces in the above-named pavilion. 

    B.    The Park Pavilions may not be used for profit unless authorized by the Parks Director.

    C.    A full refund will be given if canceled 10 days prior to the rental date.  Rentals canceled the day of due to weather may be rescheduled or refunded.

    D.    Any picnic table or area not previously reserved through the Parks and Recreation Department is available on a first come, first serve basis.

    E.    The person reserving the site is responsible for any damages to the area during their reservation.

    F.    No bounce houses or tents of any kind allowed. 

    G    Keep your receipt and confirmation with you on the day of your reservation.

    H.    Park staff will open the pavilion and display a sign with your reservation name & time.

    I.    Park in designated parking areas only.  DO NOT PARK OR DRIVE IN THE GRASS.

    J.    Unauthorized vehicles are prohibited on park grounds.  This includes any motorized vehicles, including mopeds, motorcycles, snowmobiles, ATV’s and go-carts.

    K.    Only one trash container will be provided for pavilion rentals. All other trash and litter that was carried in must be carried out. 

    NO GLASS CONTAINERS ALLOWED.  

    L.    Respect all Park property.  Take care not to damage any grass, plants, trees, shrubbery, equipment or facilities.

    M.    Fires are to be made in grills provided only.  No grills are allowed to be brought into the parks.

    N.    Fireworks are prohibited in all parks.

    O.    No weapons can be discharged or used within park property.

    P.    Public intoxication, minor consumption of alcohol and drugs are prohibited.  

    Q.    All pets must be on a leash or restrained.  Owners are responsible for cleaning up after their pets.

    R.    Help us take care of your parks.  Notify any official of any damage or vandalism you may find.  Please notify the Police if you witness anyone vandalizing or damaging Park property. 

    S.    Defacing of public property and littering are covered under the Code of Ordinances for the City of Shelbyville and are punishable and could result in a fine.

    T.    Applicant agrees that the premises will be used for the purpose stated above. Smoking is not allowed on Park property. (Could result in a fine per Code of Ordinances for the City of Shelbyville)  Applicant will be held responsible for self and guests in adhering to all Shelbyville Parks & Recreation Department rules and policies. Failure to do so will forfeit rights to obtain future facility rentals.

    U.    Applicant has examined the facility prior to the acceptance of this agreement and is satisfied with the physical condition of the premises.

    V.    Applicant agrees to keep the premises in a clean, sightly, and healthful condition and in good repair and shall yield the same back to the City in the same condition.  Applicant will be held financially responsible for any damage to the facility or its contents, including attorney fees.

    W.    Applicant shall indemnify and hold the City harmless from and against claims, damages, losses, and expenses, including but not limited to attorneys’ fees, arising out of or resulting from injury or loss during the use of the facility described herein.
