THIS AGREEMENT made by and between the City of Shelbyville by its Board of Parks and Recreation (hereafter referred to as “Parks”), and the above named Applicant and/or Group, (hereafter referred to as “Applicant”), WITNESSETH:
A. Parks, in consideration of the rents and covenants herein contained, does hereby agree to allow Applicant the use of the above-named facility on the above date and time.
B. The Meridian Park Family Aquatic Center may not be used for profit unless authorized by the Parks Director.
C. Parks lifeguards will be used during all rentals and have full authority to regulate behavior of all swimmers and guests.
D. No alcohol or smoking allowed on pool property
E. No clothing is allowed in the pool per Indiana State Board of Health. All swimmers must wear swimsuits.
F. Eating is limited to concession area only. No glass objects may be brought into the facility.
G. No floatation devices are allowed. Suits with built in floaties are acceptable.
H. Applicant is responsible for any damage to the facility or equipment caused by members of their party. This includes clean up costs for fecal accidents that happen during rental.
I. Parks is not responsible for valuables left in the dressing rooms.
J. Refund Policy - A full refund will be given if canceled 10 days prior to rental date. Full refunds may also be given if canceled prior to start due to weather or it may be rescheduled if dates are available. A partial refund may also be given if the party is cut short by weather after it begins.
K. Applicant agrees that the premises will be used for the purpose stated above. Applicant will be held responsible for self and guests in adhering to all Parks rules and policies. Failure to do so will forfeit rights to obtain future facility rentals.
L. Applicant has examined the facility prior to the acceptance of this agreement and is satisfied with the physical condition of the premises.
M. Applicant agrees to keep the premises in a clean, sightly, and healthful condition and in good repair and shall yield the same back to the Parks in the same condition. Applicant will be held financially responsible for any damage to the facility or its contents, including attorney fees.
N. Applicant shall indemnify and hold the Parks harmless from and against claims, damages, losses, and expenses, including but not limited to attorneys’ fees, arising out of or resulting from injury or loss during the use of the facility described herein.
